By using NammaPark, you agree to these terms. Please read them carefully — they govern how you can use our platform as a driver or a space owner.

📌 Use NammaPark honestly. Owners must only list spaces they have the right to list. Drivers must park within booked times. Both parties must treat each other with respect.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you ("User") and NammaPark ("NammaPark", "we", "us", "our") governing your access to and use of the NammaPark mobile application and related services.

By creating an account, downloading the app, or using any feature of the NammaPark platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our platform.

We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes your acceptance of the updated Terms.

2. Eligibility

To use NammaPark, you must meet all of the following requirements:

  • Be at least 18 years of age
  • Be a resident of India with a valid Indian mobile phone number
  • Have legal capacity to enter into binding contracts under Indian law
  • As a driver: possess a valid motor vehicle registration and, where required, a valid driving licence
  • As a space owner: have legal authority (ownership or authorised tenancy) over the parking space you list
  • Not be previously suspended or banned from the NammaPark platform

âš ī¸ We may ask you to verify your identity, vehicle registration, or property ownership at any time. Failure to provide accurate documentation may result in account suspension.

3. Account Responsibilities

You are responsible for maintaining the security and confidentiality of your NammaPark account. This includes:

  • Keeping your registered phone number active and accessible for OTP verification
  • Not sharing your account, login credentials, or booking PINs with anyone else
  • Promptly notifying us at support.nammapark@gmail.com if you suspect unauthorised account access
  • Ensuring all information in your profile — including name, vehicle details, and payout info — is accurate and up to date
  • Accepting responsibility for all activity that occurs under your account

NammaPark is not liable for any loss or damage arising from your failure to maintain account security.

4. For Space Owners

If you list a parking space on NammaPark, you agree to the following obligations:

  • You have the legal right to rent out the parking space — either as the owner or with explicit written permission from the property owner
  • All listing details (address, dimensions, vehicle type compatibility, photos, pricing, and availability) must be accurate and not misleading
  • You must keep your availability calendar up to date and not accept bookings you cannot honour
  • You must accept or reject booking requests within a reasonable time (we recommend within 1 hour)
  • You must be reachable during active bookings in case the driver needs assistance
  • You must verify the driver's booking PIN before granting access to the spot
  • You must not discriminate against any driver on the basis of religion, caste, gender, or any other protected characteristic
  • You are responsible for ensuring your space complies with all applicable local laws, housing society rules, and municipal regulations

âš ī¸ Listing a space you do not have the right to rent, or accepting payment and then denying access, may result in permanent account ban and potential legal action.

5. For Drivers

If you use NammaPark to find and book parking spaces, you agree to the following obligations:

  • Book only the vehicle type that matches the listed space (e.g. do not park a 4-wheeler in a 2-wheeler-only spot)
  • Arrive within a reasonable time of your booking start and vacate the spot by your booking end time
  • Present your correct booking PIN to the space owner to gain access
  • Not exceed your booked duration without booking an extension through the app
  • Leave the parking space in the same condition you found it — no damage, no littering
  • Not use the space for any purpose other than parking the registered vehicle
  • Complete payment within 2 hours of the owner accepting your booking request
  • Treat the space owner with courtesy and respect at all times

6. Payments & Fees

All payments on NammaPark are processed securely through Razorpay. By making a payment, you agree to Razorpay's Terms of Service in addition to these Terms.

Parking amount + 10% NammaPark platform fee per booking
Owner receives
Full listed parking amount credited to wallet. A 10% platform commission is deducted on each payout.
Auto Payout
Every Friday evening, free of charge to your registered UPI or bank account
Instant Payout
Available on demand via "Get My Earnings" with a minimal withdrawal fee.

NammaPark charges a 10% platform fee to drivers per booking and retains a 10% commission from owner payouts. These fees cover payment processing, customer support, platform maintenance, and fraud protection.

Prices are listed in Indian Rupees (INR). All applicable taxes are the responsibility of the space owner as per Indian income tax regulations.

7. Cancellations & Refunds

Our cancellation policy is designed to be simple and fair to both drivers and space owners. The rule is straightforward — cancellations made within 1 hour of the scheduled parking start time are treated differently from those made before.

Driver cancels — 1 hour before parking
Driver receives a full refund of the parking amount. No refund to the owner. NammaPark retains the 10% platform fee.
Driver cancels — within 1 hour of parking start
No refund to the driver. Owner receives the full parking amount. NammaPark retains the 10% platform fee.
Owner cancels — 1 hour before parking
Driver receives a full refund of the parking amount. No refund to the owner. NammaPark retains the 10% platform fee.
Owner cancels — within 1 hour of parking start
Driver receives a full refund of the parking amount. No refund to the owner. NammaPark retains the 10% platform fee. A cancellation strike is added to the owner's profile.
Driver no-show
If the driver paid but did not arrive, the owner keeps the full parking amount. NammaPark retains the 10% platform fee. No refund is issued to the driver.
Owner no-show / spot unavailable
If the owner's spot is unavailable on arrival, the driver receives a full refund. No refund to the owner. NammaPark retains the 10% platform fee. A cancellation strike is added to the owner's profile.

âąī¸ The 1-hour cancellation window is calculated from the scheduled parking start time, not from when the booking was placed. For example, if your parking is at 8:00 AM, the cutoff is 7:00 AM.

💰 The 10% NammaPark platform fee is non-refundable in all scenarios. It is collected at the time of payment and is separate from the parking amount paid to the space owner.

âš ī¸ Owner cancellation strikes are tracked. 3 strikes may result in temporary suspension or permanent removal of the listing from NammaPark.

Refunds are processed to the original payment method within 5–7 business days. NammaPark is not responsible for delays caused by your bank or payment provider.

8. Prohibited Conduct

The following actions are strictly prohibited on NammaPark and may result in immediate account termination and legal action:

  • Listing spaces you legally own or manage
  • Booking spaces for your registered vehicle
  • Extending bookings through the app
  • Leaving honest, factual reviews
  • Contacting owners via the in-app channel
❌ Not Allowed
  • Listing spaces without legal authority
  • Creating fake accounts or reviews
  • Sharing or misusing booking PINs
  • Harassing or threatening other users
  • Circumventing platform payments
  • Using the app for commercial subletting
  • Scraping or copying platform data

🚨 Any attempt to conduct off-platform transactions to avoid NammaPark fees is a serious breach of these Terms and will result in permanent account suspension.

9. Disclaimers

NammaPark is a technology platform that facilitates connections between space owners and drivers. We are not a parking operator, property manager, or transportation provider. Accordingly:

  • NammaPark does not guarantee the availability, safety, quality, or condition of any listed parking space
  • We are not responsible for damage to vehicles, property, or persons that occurs during a parking session
  • Space owners and drivers interact at their own risk. We strongly recommend both parties inspect the spot before and after each booking
  • NammaPark does not verify that listed spaces comply with housing society bylaws or municipal regulations — that is the owner's responsibility
  • The platform is provided "as is" and we make no warranties of uninterrupted, error-free service

10. Limitation of Liability

To the fullest extent permitted by applicable Indian law, NammaPark's total liability to you for any claim arising out of or related to these Terms or your use of the platform shall not exceed the total amount of fees paid by you to NammaPark in the 3 months preceding the claim.

In no event shall NammaPark be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

📌 These limitations apply whether the liability arises in contract, tort (including negligence), statute, or otherwise, and shall survive the termination of these Terms.

11. Termination

Either party may terminate the relationship under these Terms at any time:

  • You may delete your account at any time through the Profile → Settings → Delete Account option in the app
  • NammaPark may suspend or terminate your account immediately, without notice, if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform
  • Upon termination, your right to access the platform ceases immediately
  • Any pending payouts at the time of termination will be processed within 30 days, subject to any deductions for outstanding disputes
  • Booking records and financial transaction data will be retained as required by law

Provisions of these Terms that by their nature should survive termination — including payment obligations, disclaimers, limitation of liability, and dispute resolution — shall continue to apply.

12. Contact & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

Before initiating any legal proceedings, we encourage you to contact us to resolve the matter informally. We will make every reasonable effort to resolve disputes within 30 days.
